1. Eligibility

The Platform is intended for individuals who are 18 years of age or older. By using the Platform, you represent and warrant that you meet this age requirement. We do not knowingly allow access to individuals under the age of 18.

2. Account Registration

To access most features of the Platform, you must create a free account. When registering, you agree to:

• Provide accurate, current, and complete information
• Keep your account credentials confidential and not share your password with others
• Notify us promptly at Info@TheEnergy.Academy if you suspect unauthorized access to your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that contain false information or that violate these Terms.

3. Use of the Platform

3.1 Permitted Use

The Platform is provided for educational and professional development purposes. You may use it to:

• Access courses, videos, and microlearning content
• Track your learning progress and earn completion certificates
• Build a professional profile and connect with other industry professionals
• Save and share content for personal and professional reference
• Participate in groups, forums, and networking features

3.2 Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation
• Reproduce, distribute, sell, or sublicense any content from the Platform without our written permission
• Upload, post, or transmit any content that is defamatory, obscene, harassing, or otherwise objectionable
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Attempt to gain unauthorized access to any part of the Platform or its related systems
• Use automated tools, bots, or scrapers to access or collect content from the Platform
• Interfere with or disrupt the integrity or performance of the Platform
• Upload any malware, viruses, or other harmful code

4. Content and Intellectual Property

4.1 Our Content

All content on the Platform, including videos, course materials, graphics, logos, and text, is owned by or licensed to The Energy Academy and is protected by copyright, trademark, and other applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

4.2 Contributor Content

Content submitted by third-party contributors is provided under license to The Energy Academy. Contributors represent and warrant that they have the rights to submit their content and that it does not infringe upon any third-party intellectual property rights. We are not responsible for the accuracy or completeness of contributor-submitted content.

4.3 User-Generated Content

By submitting any content to the Platform, including profile information, notes, or comments, you grant The Energy Academy a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with the operation of the Platform. You retain ownership of your content and may remove it at any time by deleting your account or the relevant content.

4.4 DMCA / Copyright Complaints

If you believe that content on the Platform infringes your copyright, please send a notice to Info@TheEnergy.Academy with the following: (1) a description of the copyrighted work, (2) the URL where the infringing content appears, (3) your contact information, and (4) a statement that you have a good faith belief that the use is not authorized. We will respond to valid notices in accordance with the Digital Millennium Copyright Act (DMCA).

6. Advertising and Sponsored Content

The Platform includes advertising placements from third-party sponsors. All paid placements are labeled as advertising. The Energy Academy does not endorse the products or services of advertisers and is not responsible for the accuracy of advertiser claims. Any interactions you have with advertisers are solely between you and the advertiser.

We do not warrant that:

• The Platform will be uninterrupted, error-free, or secure
• Any content on the Platform is accurate, complete, or up to date
• The Platform will meet your specific professional or career needs

8. Limitation of Liability

To the fullest extent permitted by applicable law, The Energy Academy and its founders, officers, employees, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Platform or its content.

Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater. Because the Platform is currently provided free of charge, this limit will typically be $100.

9. Indemnification

You agree to indemnify and hold harmless The Energy Academy and its founders, officers, employees, and contributors from and against any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to: (1) your use of the Platform; (2) your violation of these Terms; or (3) your violation of any third-party rights.

10. Termination

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including violation of these Terms. You may also terminate your account at any time by contacting us at Info@TheEnergy.Academy.

Upon termination, your right to use the Platform ceases immediately. Sections 4, 7, 8, 9, and 12 of these Terms will survive termination.

The Platform may contain links to third-party websites or services. These links are provided for convenience only. We do not control third-party sites and are not responsible for their content, privacy practices, or terms of use. Accessing third-party links is at your own risk.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this document. For material changes, we will provide notice via email or a prominent notice on the Platform. Your continued use of the Platform after any changes constitutes your acceptance of the updated Terms.
